The writ petition has been filed by Muhammad and Ahmad, a public-interest litigation company, through its chairman Muhammad Azhar Siddique.
He also prays that the health secretary be directed to implement the Punjab Healthcare Commission Act of 2010 in letter and spirit, including establishment of Health Care Commission, the Board, appointment of commissioners, chairperson and chief executive officer as required under the Act, in the interest of public and fair play.
The petitioner says a mechanism be also evolved so that illegal strike by doctors and service providers could be dealt with an iron hand.
He requested the court that the Pakistan Medical and Dental Council be ordered to take action against the doctors who were involved in 37-day strike and had again announced strike.
He said the PMDC be also directed to cancel medical professional licences and fix permanent ban on those doctors who were involved in political and non-professional activities.
Advocate Siddique pleaded that a permanent ban on strikes of doctors in emergencies, CCU, ICU, operation theaters, outdoors and indoors and others areas, which are meant to save and protect the lives, be imposed.
The civil miscellaneous application has been filed by journalist Manzoor Qadir whose main writ petition is pending adjudication before the LHC chief justice.
Mr Qadir through his counsel M. Gull Zaman prayed to the court to declare fresh strike call by young doctors illegal under the essential services act. He pleaded for a permanent ban on the YDA involved in putting lives of millions of patients at risk.
The petitioner pointed out that the Punjab government was yet to fix responsibility of unattended patients’ deaths which took place during the 37-day long strike of young doctors.
The petitioner prays that the Punjab government be directed to take stern and immediate action against the YDA and ensure smooth functioning of public infirmaries.
LHC Chief Justice Ijaz Ahmad Chaudhry will hear both petitions on Monday.
